Terms and conditions

General
Connexxion offers you the opportunity to use -and thus provides access to- free wireless internet connection services via our WiFi facilities. When using these facilities, you must at all times comply with these terms and conditions. Using the WiFi service is not allowed when you intend to act contradictory to the following:

Responsibilities and liability
You are personally and fully responsible and liable for all content (data and information, whether spoken, transmitted digitally or in any other way) that you handle, download, send and/or spread during and/or while making use of an active connection with the wireless internet connection (WiFi), provided by Connexxion. Connexxion can and will in no case take responsibility, either fully or in part, for your online activities or lack thereof. Where Connexxion is forced to release or distribute, e.g. on legal grounds or when receiving legal claim thereto, data or information of any kind with regards to WiFi use, Connexxion may comply without prior notice or reservation.

By making use of the wireless internet connection (WiFi), provided by Connexxion, you agree to the following terms, restrictions and guidelines:

It is, at all times, strictly prohibited to:
- Seek access to and/or connect in any way with content that is or may be considered harmful, indecent, pornographic, discriminating/racist, violent and/or offensive in any way;
- Send, distribute and/or wilfully cause transmission of spam or otherwise objectionably large quantities of e-mail (or other digital messages) through the wireless internet connection (WiFi), provided by Connexxion;
- Post or send offensive, discriminating, racist, threatening or otherwise harmful/insulting messages (e.g. on forums, communities or through social media platforms, chat facilities, applications et cetera) via the wireless internet connection (WiFi), provided by Connexxion;
- Handle, download, upload or distribute viruses and/or any other type of malware (including Trojans, logic bombs and such) as long as you are (trying to get) connected with (any component of) the wireless internet connection (WiFi), provided by Connexxion;
- (Attempt to) break, hijack, hack, (re)configure regardless which network and/or any (other) hardware and/or software, made available by Connexxion, or to violate and/or bypass any of the security measures in place. This obviously also applies to any material (software, hardware, content) that is not expressly provided or made available by Connexxion but in range when using and/or trying to use the provided WiFi service;
- Engage in any way in illegal activities, regardless of their kind and nature, when using and/or trying to use the wireless internet connection (WiFi), provided by Connexxion.

When you are underage
When you have not yet reached the age of 18, but you are over 12 years old, permission of your parent(s) and/or legal guardian(s) is required to use the wireless internet connection (WiFi) that is provided by Connexxion. Where this age category applies to you, the required permission is indicated by your use of the provided facilities.

If you have not yet reached the age of 13, you are not allowed to use the wireless internet connection (WiFi), provided by Connexxion. This restriction is lifted only after Connexxion is provided with proof, i.e. written consent of your parent(s) and/or legal guardian(s), of the required permission.

Parents or legal guardians of one or more minor(s), who gave him/her/them permission to use the wireless internet connection, thereby at least agree to:

1) Supervise and overlook these minors' usage of the wireless internet connection (WiFi), provided by Connexxion and their access to the internet and connected digital services;
2) Accept all risks and consequences that are connected with (the possibility of) these minors' use of and access to content / digital materials, through the provided wireless internet connection (WiFi);
3) Accept all risks and consequences connected with these minors' (possibility of) sending and/or transmitting any content or data through the internet, by using the wireless internet connection (WiFi), provided by Connexxion;
4) Accept, without reservation or restriction, all responsibility and liability that follows from the abovementioned and the actual use of any internet-based facility that is activated, consulted or otherwise used via the wireless internet connection (WiFi), provided by Connexxion, including any and all (possible and/or potential) financial responsibilities.

Limitation of liability
With the exception of intent, fraud or gross negligence on its part, Connexxion, its subsidiaries, suppliers, intermediaries, employees and affiliates are in no way responsible and/or liable for any direct, indirect and/or incidental (consequential) loss or damages or any other incurred loss or damage, including but not limited to: errors, failures, slow services, (un)reachable services/content, copyright infringement or violation by users of the service provided or services accessible, damaged, removed, created and/or altered (digital) files, viruses or any other type of malware, theft or loss of data and/or damage or change to the user's software and/or hardware, resulting from, or as an either direct or indirect consequence of, or in any way related to the (possibility to use (or lack thereof) the wireless internet connection (WiFi), provided by Connexxion.

Privacy and Confidentiality
Information that is distributed (sent, downloaded, exchanged, handled et cetera), and (thus) the data/content that is handled via the wireless internet connection (WiFi), provided by Connexxion, is not treated as strictly confidential material or complementary secured with additional security measures to prevent loss, unauthorised use and such. Connexxion can and will not guarantee the user's privacy when he/she uses the wireless internet connection (WiFi), provided by Connexxion, for as far as such regards the actual use of the WiFi connection and/or data handled via that free service. Connexxion reserves the right to monitor (any part of) the data transmission through / via the wireless internet connection (WiFi), provided by Connexxion, where such is (considered) necessary to offer (or keep offering) proper services and/or in order to protect and secure the equipment, people and means that either belong to, or are brought under the care of, Connexxion.

When these restrictions, terms and conditions are not respected
Connexxion reserves the right to, at any time and without prior notice or reservation of any kind, withdraw or limit the use of the wireless internet connection (WiFi), provided by Connexxion, or any other (part of) service(s) offered by Connexxion, either in whole or in part and for any user, where that user is (suspected of being) involved in any misconduct or activity that, to the sole discretion of Connexxion, is in violation of any of these terms, restrictions and conditions.

Where the English version of this document leads to any discrepancy and / or dispute, the Dutch version will be leading in any Court of the law.
